Terms and Conditions
In these Terms and Conditions, the ‘Company or Organisation’ shall mean Supertime African Tours cc and the ‘Client’ shall mean the person or Agent who has signed a booking form as the lead booking name and all persons in the booking form to travel with Supertime African Tours. The Company endeavours to ensure the accuracy of the tour and activities prices, however such pricing is subject to change as result of factors beyond the company’s reasonable control, in which event the company shall utilize its best efforts to notify clients of such change as soon as it is reasonably possible.
Contract
There shall be no binding contract between the client and the company until the following conditions are met:
1) the client has agreed on the itinerary and quote provided for the tour or activity
2) the booking will then be considered confirmed when an invoice is issued and a 30% deposit has been paid
3) the booking terms and conditions have been confirmed by the client
The sub-contracted supplier will be governed by the laws of the country in which the supplier is located and will be subject to the exclusive jurisdiction of the Courts of that country
Payments
Once Supertime African Tours cc has accepted your booking, the date of the confirmation invoice activates the terms and conditions of the contract
Confirmation of services is subject to payment of a non-refundable deposit of 30% of the total invoiced amount
The balance is to be paid not later than 60 days prior to commencement of the services
When bookings are made within 60 days prior to the departure date, full payment is required immediately on written confirmation
If payments are not received within the above time frame, Supertime African Tours reserves the right to cancel the tour which has been booked and retain any deposit received to set against expenses incurred in the booking of such a tour
The following payment systems will apply:
• Bank Transfers
• Visa or Mastercard Credit cards, however this attracts a 4% surcharge
All bookings are subject to availability at the time of booking and cannot be guaranteed
Prices
Prices in this brochure are quoted in US dollars
All prices are subject to change without prior notice
Should prices or costs from suppliers increase due to inflation, currency depreciation and fuel surcharges, the Company will not have any other option than to pass on the same to you
All suppliers reserve the right to increase prices at any time of the year when costs increase outside the control of the supplier
Please note that when the clients’ itinerary overlaps two seasons, the price will be prorated over the two seasons
Cancellation Policy
Any cancellation of a booking by a Client must be in writing and shall only be effective upon its acknowledged receipt by the Company
The date on which the Company receives the correspondence will determine the cancellation charge, if any
In such case the following cancellation charges will be applied:
• If cancelled out of 60 days, full deposit will be forfeited
• If cancelled 60 days and under, 100% cancellation charges will apply
• Unused portion of any Safari or Tour is not refundable
Although it rarely happens, and Supertime African Tours will do their utmost to avoid doing so, the company reserves the right to cancel tours and other arrangements
Where cancellation is done (other than due to your default in payment) following unavoidable circumstances beyond our control e.g. over bookings, the company will offer you the choice of purchasing an alternative tour or activity (and paying or receiving a refund in respect of any price difference) or receiving a full and immediate refund of all monies paid for the initial services
Changes and Alterations
“Force Majeure” means, in relation to the Company, any circumstances beyond the reasonable control of the Company (including, but not limited to, acts of God, explosion, flood, fire, war or threat of war, sabotage, civil disturbance, quarantine, government intervention, weather conditions or other unexpected occurrences)
The Company shall not be deemed to be in breach of these terms and conditions or otherwise be liable to the Client, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure
If the Company is affected by Force Majeure, it shall be entitled to, and may in its sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the tour or safari
No refunds are given for circumstances arising beyond the Company’s control, necessitating alternative arrangements being made to ensure the safety and/or further participation and enjoyment of the tour or safari
The company reserves the right to cancel the tour without prior notification and in such an event only agrees to refund all monies already paid and received from client
Insurance
Travel and cancellation insurance is mandatory for every Client
All insurance is solely the responsibility of the Client
Before a Client commences a tour, he/she should arrange his/her own insurance with protection for the full duration of the travel, to cover including but not limited to, personal injury, damage and loss of personal items including but not limited to camera equipment and other electronic equipment, medical expenses, repatriation expenses and loss of luggage
If a Client falls ill, all hospital expenses, medical expenses, doctor’s fees and repatriation costs are the Client’s responsibility and the Company shall not be liable for any refund of the tour rate whatsoever
Liability
The Client hereby acknowledges, confirms and records that he/she understands the risk inherent in adventure travel in African destinations and associated activities
The Client is accepted onto the tour and undertakes to do the tour, travel or activity at his/her own risk
The client agrees and concedes that the Company, its representatives and employees shall not be responsible for loss or damage to possessions, or injury or illness to the client or loss of life or consequential damages which might occur from any cause whatsoever, unless directly caused by the Company’s negligence
Company Responsibility and Rights
The information in any brochure and printed itineraries is given in good faith by the Company, and is based on the latest information available to the Company
Printed itineraries serve as a guideline only
The Company reserves the right to correct any errors both before and after the booking has been made, change the facilities or transport of comparable status described in any publication without being liable for any compensation or refund
In this event, the company will inform the Client at the earliest opportunity
Client Responsibility
It is the Client’s sole responsibility to ensure that passports, visas, travel permits and inoculations required for the tour, are obtained well in advance and are in order in terms of all the countries to be visited
It is the Client’s responsibility to meet any additional costs incurred either by the Client (or by the Company on the Client’s behalf) as a result of any failure by the Client to comply with such requirements
The Company may not be held liable for any failure on the part of a client to be in possession of the correct travel documentation
The onus is on the Client concerned to fully acquaint themselves with the Terms and Conditions set herein and all matters such as visas, required documentation, payment schedules and cancellation policies
It is the Client’s responsibility to check the latest FCO advice (foreign & commonwealth office) for the countries they will be travelling to
Rates include
Services specified in the itinerary
Accommodation with meals, tours, transport, driver/guide, park entrance fees, hotel taxes and service charges
Rates exclude
Unless specified otherwise: Medical Air Rescue services, Porterage, Domestic Air Charters, Visa Fees, Beverages, Laundry, Telephone Calls, Scheduled Flights, Gratuities and all expenses of personal nature
Child rate
Only applicable to one child under 12 years sharing a room with 2 adults
01 child sharing a room with 01 adult will be charged full adult rate
Single Room Policy
Please note that single rooms are scarce and cannot be guaranteed
Suppliers/Vendors may only allow a maximum of 3 single rooms per group
Booking Alterations
(a) Should a Client wish to make any changes on the confirmed booking arrangements, the Company will endeavour to assist
This will only be allowed if the Client notify the Company in writing at least 65 days before utilization of the Company’s services
Such alteration may be subject to US$ 30 per person to cover administration costs and any further charges incurred or imposed by any of the Vendors in making the requested alteration
Complaints
In the unlikely event that the client has a complaint against the company, the Company must be informed immediately, in order that an opportunity is afforded to the company or its representative to investigate the situation and provide redress at the very opportunity
If the client has any further complaints, these must be lodged in writing to the Company within 21 days of the tour end date
If these procedures are not followed, regrettably, the Company cannot accept responsibility of any complaints, which are not notified entirely in accordance to this clause
Company’s Responsibility
The company acts only as the Agent for the suppliers and shall not in any event be liable for any negligence, breach of contract or acts of omission on the part of vendors, their employees or any other Agent
It shall be the responsibility of all customers including and without limitations Tour participants, Tour Operators and Travel Agents, to read and familiarize themselves with the terms and conditions of suppliers
The company’s liability for its own negligence or breach of contract shall be limited to the tour price
Transportation
The custom-built 4×4 safari vehicles will be provided according to the route and number of participants
The company reserves the right to employ services of sub-contracted vendor if the need arises
Multi-lingual driver guides are provided on request and subject to their availability and at an extra cost not included in the rates but offered separately
Clients will share vehicles with other guests booked at the hotel on Flying packages
For exclusive services, please check with the Company for supplements, subject to availability
Special Requests
Any special requests like single rooms or particular diet must be notified in writing when the booking is made
Whilst the supplier/vendor will endeavour to meet such requests, regrettably they cannot be guaranteed and any failure to comply with, will not be a breach of contract
Luggage
Baggage allowance on our local scheduled flights is strictly 15 kgs per person and soft bags are strongly recommended
In light aircrafts, the baggage area and weight allowances are limited and hard Samsonite-type suitcases do not fit into the cargo compartments
Additionally, due to limited available storage space in safari vehicles, the company strongly recommends use of soft duffle bags and not hard suitcases
